In a highly contentious argument that ran well past its allotted one hour on Wednesday, the justices of the U.S. Supreme Court clashed over the constitutionality of a university policy that considers race as a factor in admissions decisions.
Three of the eight justices that heard oral arguments in Fisher v. University of Texas at Austin (Justice Elena Kagan recused herself) expressed open doubt that the policy passed muster under the Equal Protection Clause - and Justice Clarence Thomas, who didn't speak during the arguments - could hold a similar view. Three justices seemed prepared to uphold the measure. That means the fate of the plan, as well as similar affirmative action policies across the nation, could rest with one justice: Justice Anthony M. Kennedy.

ALBANY, N.Y. - New York Attorney General Eric Schneiderman, on behalf of 14 states, is urging the U.S. Supreme Court to uphold racial preferences in college admissions.
The court is scheduled to hear arguments Oct. 10 in a lawsuit by Abigail Fisher, a white student who was not admitted to the University of Texas in 2008. Fisher is challenging the university's admissions policy as a violation of her civil and constitutional rights.

Election pundits have repeatedly asked why Sen. Barack Obama, D-IIl., has trouble attracting blue collar whites, as if he created the problem and could solve it. Sen. Hillary Clinton, D-N.Y, is seldom asked why Blacks, don't vote for her, a problem she could solve. But it is interesting why blue collar whites consistently vote against themselves, supporting Republicans who care little about their problems.
The South has played a major role in harboring negative racial attitudes toward Blacks which is why Obama has attracted such a small percentage of whites there, a surprise it seems to media commentators.
