• Right Back 'in Facie Curiae'-a Statistical Analysis of Appellate Affirmance Rates in Court-Initiated Attorney-Contempt Proceedings

I ran smack into the intricacies of the court's inherent contempt power during my first several months on the bench. A wellknown attorney in Arkansas double-booked himself for trial and simply did not show up in my court for a four-day criminal jury trial. I initiated contempt proceedings and, despite earnest efforts to learn and follow appropriate contempt procedure, the Arkansas Supreme Court only affirmed my contempt decision 4-3. It was not until I conducted the study research for this article, that I learned that court-initiated attorney-contempt cases in Arkansas have only an 18% affirmance rate. Appellant appeals the trial court's affirmance of the Board of Education's decision to (1) revoke his 3-year pupil activity supervisor permit, (2) deny his application for a 2-year provisional teaching license and (3) declare him permanently ineligible to apply for any license. The Board based its decision on appellant's felony convictions and underlying "conduct unbecoming an educator." The trial court found the Board's decision to be supported by reliable, probative and substantial evidence and that it was neither illegal nor arbitrary. The assigned errors challenge only the court's affirmance of the Board's order as to (3). Finding no error, we affirm the court's ruling.
