This Note proposes that the engine of tobacco policy in the United States—the nonsmokers’ rights movement—has largely and successfully run its course, leaving the United States primed for greater paternalistic tobacco regulation. Sure enough, we may be witnessing a sea change in tobacco policy with the introduction of the Family Smoking Prevention and Tobacco Control Act.
