In the most recent shooting, [Steve Mattocks] ran to the aid of officer Christopher Swanson, who fell to the ground saying he was shot, [Dan Ortega] said, adding that Mattocks then saw [Julio Hernandez] reaching across the center console with what appeared to be a gun. "The totality of officer Mattocks' observations caused him to believe the male passenger had a firearm and had shot Officer Swanson and was going to continue shooting at the officer," he said.
Aptos attorney Ornar James says he will sue the city for violating Hernandez and [Adriana Velasquez]'s constitutional rights and causing them emotional distress.

Dr. Vandana Agarwal, a physician with New Hope Cancer and Research Institute, and Adriana Hernandez, a parent volunteer assisting the Los Angeles County Fire Department Explorer Program, were local honorees.
Crescencio Padilla of the League of the United American Citizens, which has investigated previous officer-involved shootings, says the streak of incidents has hurt community-police relations. "That's why [Salinas] residents don't cooperate with the police, he says. "They don't trust them.
Aptos attorney Omar James, who is representing [Julio Hernandez] and [Adriana Velasquez], says he will sue the city for violating the Salinas residents' constitutional rights and causing emotional distress. "You can't take lightly the use of deadly force," James says. "We live by rule of law. But when the rule of law is violated by the people who are there to protect you, you have anarchy."

CONDUCT UNBECOMING...A former Salinas police officer has been charged with a felony for opening fire on an unarmed couple. Christopher Swanson shot at Adriana Velasquez and Julio Hernandez on Feb. 3 after Swanson thought he heard a pop and saw a muzzle flash, then fell, to the ground saying he was shot, according to police. Both Swanson and Officer Steve Mattocks fired multiple rounds, remarkably not injuring anyone. Swanson, who was fired after the incident, will be arraigned on a felony charge of discharging a firearm in a grossly negligent manner on Aug 11. The DA's Office didn't file charges against Mattocks. The recent ruling allowing René Gonzalez to finish out his probation in Cuba is the first sign of sensible and decent behavior on the part of the U.S. criminal justice system in this controversial case of five Cuban intelligence officers unjustly sentenced to long jail terms for trying to protect their homeland against terrorist attacks and sabotage. Many of these exile groups were known to have a history of terrorist activities against their former homeland. Since the triumph of the Cuban Revolution in 1959, more than 600 incidents of terrorism have been documented, costing the lives of 3,400 civilians with thousands more injured.
