The US Treasury Department issued a notice of proposed rules this past February, one of which addressed the publicity of disciplinary hearings arising from Circular 230 violations. The proposed regulations rename former Section 10.71 as 10.72; then designates paragraphs (b), (c), and (d) as (d), (e), and (f) respectively. The new Section 10.72(d) now mandates that all pleadings filed with the administrative law judge, all evidence received by the administrative law judge, and all reports and decisions of the administrative law judge will be made public, with privacy protections afforded to taxpayer-specific information. Publicity of all Circular 230 disciplinary hearings establishes a published record for the profession, which can be used for both clarification and setting of precedents.
