The lobbying expense disallowance proposed regulations issued by the IRS in May 1994 are focused on defining influencing legislation, but the definition is overbroad and the regulations impose substantial administrative burdens. Under IRC section 162(e), expenses incurred in influencing legislation or communicating directly with certain government officials are no longer deductible. The regulations extend nondeductibility to activities such as research that may not be initiated with any lobbying intent. The imputation rules also misunderstand the activities of trade associations.
