This final rule amends the Pension Benefit Guaranty Corporation's administrative review regulation to make it applicable to assessments of penalties for failure to timely provide certain notices or other material information. Under the rule, such assessments will be subject to reconsideration in accordance with the provisions of the regulation.

With the decisions issued at the close of its fiscal year in September of 2007, the National Labor Relations Board (Labor Board) has come under heavy criticism from union and political leaders, as well as academicians. This article will discuss the politicization of the Labor Board. It will present the US Supreme Court's analytical framework for reviewing administrative agency policymaking decisions, as set forth in its landmark Chevron USA v. Natural Resources Defense Council Inc decision.
