Charges against a former St. Bonaventure University student accused of raping a classmate in her dormitory room will be dismissed in a year if he stays out of trouble. William T. Markey, 21, of Baldwinsville, near Syracuse, was granted an adjournment in contemplation of dismissal Friday by Cattaraugus County Judge Michael L. Nenno.
Deborah Powell on Wednesday was granted a delayed dismissal on an assault charge in a fight Jan. 31 at Northampton Street and Fillmore Avenue with fellow East High School student Adrianna Jackson. Mayor Byron W. Brown's son was spared a criminal conviction Monday when a judge granted him and a longtime friend delayed dismissals on shoplifting charges, as recommended by prosecutors. It was the second encounter with the courts in three years for Byron W. Brown Jr. Buffalo City Judge David M. Manz warned him and Xavier Jemison that they have to complete a four-hour shoplifting class and stay out of trouble for the next six months. Former Buffalo Bills wide receiver Eric Moulds on Thursday was spared further criminal proceedings on a harassment complaint lodged months ago by his former live-in lover. Moulds was accused of striking the woman in the Amherst home they had shared. At the request of prosecutors, State Supreme Court Justice Deborah A. Haendiges issued a one-year "adjournment in contemplation of dismissal" to Moulds, 36, a member of the Bills all-time offensive squad as voted on by fans last year.
An Adjournment in Contemplation of Dismissal (ACD) and a probationary sentence are similar in that both are revocable. Conditions are attached to each. A trespassing charge against Channel 4 meteorologist Mike Cejka will be dismissed in six months as long as he stays away from the home of an Old Beattie Road man who lodged the complaint. Town Justice Raymond E. Schilling granted a six-month adjournment in contemplation of dismissal for a trespassing violation against Cejka, 50, of Clarence, during a brief hearing Tuesday night in Lockport Town Court at which an attorney appeared on Cejka's behalf.
