St. Louis-based general contractor McGrath & Associates recently completed a $1.825 million operating room expansion and an $850,000 cath lab renovation and expansion at Des Peres Hospital. McGrath provided construction management and general contracting services for the 16,000-square-foot operating room and the 5,300-square- foot, third-floor cath lab. Application for writs of mandamus and/or procedendo were rendered moot when the respondent judge ruled on the outstanding matters of jail time credit and postconviction relief. This court declined to issue a writ to compel service, because the relator had notice and knowledge of the judges rulings. Mandamus does not lie to compel the general observance of the law or in anticipation of breach of a duty. There is no claim for money damages against a judge for litigation expenses caused by the judges delay in ruling on a matter.
