The maker of a powder infant formula may be liable for brain damage suffered by a newborn who contracted a form of meningitis after being fed the company's product, a U.S. District Court in Iowa has ruled in denying a motion to dismiss.
The plaintiff is the conservator for a child who suffered severe brain damage due to E. sakazakii meningitis that she contracted ten days after being born. The onset of the illness coincided with her ingesting infant formula made with Similac powder, an Abbott Laboratories product. The Similac formula was sent home with the child's mother in a hospital gift bag.

Two separate settlements with Illinois-based pharmaceutical giant Abbott Laboratories were announced Monday by Attorney General Eric T. Schneiderman.
The cases involve the marketing and sale of the anti-seizure drug Depakote for unapproved uses. The first is a $1.5 billion global settlement with other states and the federal government to settle civil and criminal allegations that Abbott Laboratories illegally marketed Depakote. New York's share is $50 million. The second is a $100 million settlement reached by Schneiderman with 44 other state attorneys general and the District of Columbia from alleged improper marketing and promotion of Depakote.

TIPP CITY -- Abbott Laboratories' journey to last week's announcement of plans to build a $270 million nutritional drinks manufacturing plant off County Road 25A started with information the city provided on a state Internet listing of industrial sites.
Details of the effort to attract the plant and 240 jobs along with local incentives for the Chicago-area based company were outlined March 2 for Tipp City Council at the beginning of a daylong planning retreat.
