Tenth Survey of White Collar Crime
Conspiracy, one of the most frequently charged federal crimes, is covered under 18 U.S.C. 371. Major elements of the offense include an agreement between at least two parties, illegal goal, knowledge and voluntary participation, and commission of an overt act. Defenses include the statute of limitations, insufficiency of indictment, variance, multiplicitous indictment, insufficient evidence, and withdrawal from the conspiracy. Testimony from co-conspirators is allowed as an exception to the hearsay rule, which raises evidentiary and Sixth Amendment issues. Enforcement and sentencing are also discussed.
